This legal notice sets out the general terms governing access to and use of the website silviacatala.com (the “WEBSITE”), which is owned by Odontologia Berné, S.L., a company domiciled at C/ Josep Viladomat, 14, Edifici Caldes, 1r 2a, AD700 Escaldes-Engordany (Principality of Andorra), registered in the Companies Register of the Principality of Andorra with tax registration number (NRT) L-708765-Z and in the Commercial Register under number 923118 (the “OWNER”). Access to the WEBSITE is free of charge and viewing it does not require any prior registration or subscription. The WEBSITE provides general information about our services.

Limitation of liability

The OWNER accepts no liability for any loss or damage of any kind, whether caused or that may be caused, arising from the use of the information, the content of the WEBSITE and the programs it includes, including but not limited to: errors or omissions in the content, unavailability of the WEBSITE, or the transmission of viruses or malicious or harmful programs in the content, despite having taken all technological measures necessary to prevent this.

The information on the WEBSITE is current as of the date of the last update. The OWNER does not guarantee that access to the WEBSITE or its content will be free of errors, but will take appropriate measures to prevent, correct and/or update them as soon as they are detected.

The OWNER reserves the right to modify and update the information on the WEBSITE, its presentation and configuration, and the conditions of access at any time and without prior notice. The OWNER also reserves the right to modify and/or remove all or part of the content of the WEBSITE and to restrict access to it.

User responsibilities

Users are responsible for complying with the laws and regulations in force and with the rules applicable to their use of the products and applications.

Any use of the WEBSITE contrary to good faith is prohibited, in particular and without limitation: use contrary to Andorran law or that infringes the rights of third parties; publishing or transmitting any content that is violent, obscene, abusive, unlawful, racist, xenophobic or defamatory; altering or interfering by fraudulent means with personal web pages, emails or systems of other users or third parties without their authorisation; cracks, software serial numbers or any other content that infringes the intellectual property rights of third parties; collecting and/or using other users’ personal data without their express consent or in breach of Qualified Law 29/2021 on the protection of personal data; using the mail server, the domain and email addresses for spam, mail bombing, identity theft, fraud, spreading viruses (Trojans, etc.) or any other activity carried out with fraudulent or criminal intent.

Accessing, modifying or viewing the configuration, structure and files of the WEBSITE’s servers is expressly prohibited. Should any problem arise in the WEBSITE’s servers and security systems as a direct result of negligent action by a user, that user shall bear the corresponding civil and criminal liability. Users shall respect the technical standards set by the WEBSITE for the administration and development of the products used, so as not to make abusive use that slows down the servers and harms the provision of the products or the rights of other users.

Personal data protection and cookies

In accordance with Qualified Law 29/2021 of 28 October on the protection of personal data (the “LQPD”) and its implementing regulations, users of this website are informed that any personal data provided to the OWNER will be processed by it for the purposes and under the conditions defined in its Register of Processing Activities.

The data controller is the OWNER, domiciled at C/ Josep Viladomat, 14, Edifici Caldes, 1r 2a, AD700 Escaldes-Engordany (Principality of Andorra).

The WEBSITE has no forms and does not collect any personal data from users. Any data that users voluntarily provide by phone or email will be processed in order to answer their enquiry and, where applicable, to manage their appointment.

In accordance with the LQPD and its implementing regulations, the OWNER informs you that you have the rights of access, rectification, erasure, objection, portability and restriction of processing recognised by that legislation, which you may exercise by writing to the OWNER at the address given above or by email to [email protected]. You may also lodge a complaint with the Agència Andorrana de Protecció de Dades (www.apda.ad).

The WEBSITE does not use cookies or any other tracking or analytics technology. Should such technologies be added in the future, this legal notice will be updated and users will be informed.

Intellectual property in the content

All elements appearing on the WEBSITE, without limitation (photographs, music, sounds, animations, software, text, domain name, trademarks, information and content compiled from the whole website, etc.), as well as its structure, graphic design and source code, are the property of the OWNER or, where applicable, of third parties who have granted it the corresponding rights of use.
